The below information summarizes portions of these two acts. Topics include: Emergency Paid Sick Leave, Family and Medical Leave Act (FMLA), Direct Stimulus Payments, and Expanded Unemployment Insurance.
Emergency Paid Sick Leave: requires certain employers to provide their employees with paid sick leave for specific reasons related to COVID-19.
Effective Dates: April 2, 2020 to December 31, 2020
Eligibility: employees of private sector, employers with fewer than 500 employees, and certain public sector employers, are eligible for up to two weeks, or 80 hours, of fully or partially paid sick leave related to COVID-19 if the employee is unable to work, including unable to telework, because the employee has a qualifying reason for leave related to COVID-19 (listed below).
*Note: Employees who have been employed for at least 30 days prior to their leave request may be eligible for up to an additional 10 weeks of partially paid expanded family and medical leave if they are caring for his or her child whose school or place of care is closed (or child care provider is unavailable) due to COVID-19 reasons.
Qualifying Reasons for leave related to COVID-19:
- Is subject to a Federal, State, or local quarantine or isolation order related to COVID-19
- Has been advised by a health care provider to self-quarantine related to COVID-19
- Is experiencing COVID-19 symptoms and is seeking a medical diagnosis
- Is caring for an individual subject to an order described in (1) or self-quarantine as described in (2)
- Is caring for his or her child whose school or place of care is closed (or childcare provider is unavailable) due to COVID-19 related reasons
- Is experiencing any other substantially similar condition specified by the U.S. Department of Health and Human Services.
Paid Leave Entitlements: Up to two weeks (80 hours, or a part-time employee’s two-week equivalent) of paid sick leave based on the higher of their regular rate of pay, or the state or Federal minimum wage. This is paid at:
--100% for qualifying reasons #1-3 above, up to $511 daily and $5,110 total
--2/3rds for qualifying reasons #4 and #6 above, up to $200 daily and $2,000 total
--Up to 12 weeks of paid sick leave and expanded FMLA paid at 2/3rds for qualifying reason #5 above, up to $200 daily and $12,000 total
--A part-time employee is eligible for leave for the number of hours that the employee is normally scheduled to work over that period.
Family and Medical Leave Act (FMLA): requires certain employers to provide their employees with FMLA for specific reasons related to COVID-19.
Effective Dates: April 2, 2020 to December 31, 2020
Eligibility: Employees must have been employed at least 30 days and unable to work because they must care for a child (under 18 years of age) whose school or childcare provider is closed or unavailable for reasons related to COVIDE-19
--Full-time employees are eligible for an additional 10 weeks of leave (40 hours per week) paid at 2/3rds
the employee’s regular rate of pay or states minimum wage up to $200/day and $10,000 over the
benefit period. The first 10 days of this leave may be taken as unpaid.
--Part-time employees are eligible for number of hours they would normally be scheduled to work over
that period.
Applicable employers and tax credits for paid sick leave and FMLA Expansion:
Eligibility: Provisions apply to private businesses with less than 500 employees and all public employers. The U.S. Secretary of Labor would be empowered to grant hardship exemptions for certain businesses with fewer than 50 employees and to exclude certain health care providers and emergency responders.
Reimbursement: Employers will be reimbursed through a payroll tax credit for both emergency paid sick leave and expanded FMLA which applies to for-profit and non-profit employers equal to 100% of the qualified wages paid.
Equivalent tax credits are available to self-employed individuals based on similar circumstances in the amount of:
--$511/day or 100% of regular rate of pay for employees on leave for own diagnosis.
--$200 per day or 2/3rds regular rate of pay for employees on leave to care for an individual quarantined, care for a child whose school/daycare is closed or employee experiencing “substantially similar condition” as specified by HHS.

Direct stimulus payments to individuals and families: The IRS will issue one-time rebate checks based on 2019 tax return (or 2018) if filed. For most Americans, no action on their part is required.
Eligible: People who meet income guidelines listed, people with no income, and people who receive Social Security benefits but don’t file tax returns- the check amount will be based on information provided by the Social Security Administration.
NOT Eligible: Dependents over age 17 and Tax filers without SSNs (such as Dreamers and families of filers with only individual Taxpayer Identification Numbers)
Stimulus Payments: one-time payments are made based on tax filing status and adjusted gross income as follows:
--Individuals earning up to $75,000 get $1,200. This includes a married person filing separately.
--Individual filing as head of household earning up to $112,500 adjusted gross income gets $1,200
--Married couples (same sex included) filing a joint return up to $150,00 adjusted gross income get $2,400.
--Families get $500 per child under age 17. For example, family of four earning less than $150,000 can expect $3,400.
Thresholds: Checks are reduced by $5 for every $100 that a taxpayer’s income exceeds the phase-out threshold. Payment completely phased out for:
--$99,000 for single filers
--$146,500 for head of household with one child
--$198,000 for joint filers with no children
Groups that may struggle to get payment and will need to take action to be eligible:
--People who did not file tax return because they earned less than the standard deduction ($12,300 single/ $24,400 joint filer)
--People who earn cash income but didn’t report it.
Expanded Unemployment Insurance: Temporary Pandemic Unemployment Assistance (PUA) benefits program created for workers whose employment ended as a direct result of COVID-19 crisis.
Effective Dates: Benefits can apply as early as January 27, 2020 through December 31, 2020. PUA extends usual 26-week benefit to 39 weeks. See more info here detailing state benefits for usual unemployment insurance and related PUA extension information.
Eligible: People whose employment ended as a direct result of the COVID-19 crisis, individuals who are not traditionally eligible for unemployment insurance (such as self-employed or independent contractors, including “gig” workers
NOT Eligible: People who voluntarily quit their job for reasons not related to COVID-19 crisis (this is same as restriction in traditional unemployment insurance)
Application: An individual applies for PUA benefits with the state agency where he or she lives.
Required to Certify: An individual must self-certify that he/she is otherwise able to work and available for work within the meaning of applicable state law except that the individual is “unemployed, partially unemployed, or unable to unavailable to work” for one of the following eleven reasons:
- Diagnosed with COVID-19
- Has symptoms and is in the process of seeking medical diagnosis
- Household member has COVID-19
- Providing care to household member with COVID-19
- Caregiving for child or primary caregiver for household member that is unable to attend school or daycare due to COVID-19
- Individual is unable to reach work due to a quarantine or hear care provider advised to self-quarantine
- Individual is unable to reach hob as direct result of COVID-19
- Individual is the sole wage earner in his/her household due to death of the head of household as a result of COVID-19
- Individual required to stop work as a result of COVID-19
- Individuals place of employment closed due to COVID-19
- The individual is self-employed, is seeking part-time employment, does not have sufficient work history, or otherwise would not qualify for unemployment benefits under another state unemployment program
